Can I do K-1 paperword TOO early

Timeline

I did not get alot of response to my last topic as it was vague, so i will rephrase...

Is it possible to start this process 3 months before going to Ukraine and then SLOW it down as I make progress, or will it screw up the works

My plan was to follow the timetable guidelines but do it THIS way.

Start the process in February, go as far as I can in the process with certified copies, etc, until such time as I need to use the LADIES info, pictures, etc, then when i hit Ukraine in May and we finally decide to get engaged (99% postive now), then we get her passport photos, fill in the blanks and I will have ll MY copied certified to give her to keep while I head back to USA

Will this work, so that I don't have to be FedEx documents. Where does the STEP that requires pictures of us together and proof, etc come into the process and can I hold up any progress to MY benefit as far as time goes without having to start over?

lets see if this is clearer for everyone involved?

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Have you met in person yet? You have to meet in person within 2 years before you can file anything.

You need to have met before filing the I-129f. You also should present EVERYTHING the I-129f requires when you file it.

What you're suggesting is sending in only part of the petition, and waiting for the RFE to provide everything else, thus saving some of the waiting time.

I see where you're coming from, but with with those things missing, I wouldn't expect an RFE. I'd expect a denial.

Not only will you be out $500+, but you will also be starting from square one with more difficulty than if you had waited in the first place.

Just wait until you have met all the requirements and have all the evidence required to prove it.

No, what I was saying is that we are meeting in Ukraine for 2 weeks may 1st, but have been talking for 6 months. We both agreed on Engagement in Spring, so i wanted to take everything i need with me, have as much done from USA before I leave, so I could COMPLETE the package over there, then FILE as soon as I got back, and leave her copies before I left, as I cannot get back over for 6 months.

What am I missing in this equation. Are you saying I can't do it this way?As i understand, you say I won't have everything i need BEFORE going over, so I can't file anyways

You need to have met before filing the I-129f. You also should present EVERYTHING the I-129f requires when you file it.

The base requirements to file for a K-1 are that you have met your fiance in person within the last 2 years, and that you are both free to marry. Note that you must meet these requirements at the time of filing. So technically you could step off the airplane, give your fiancee a hug, have her sign the 4 copies of the G-325A and the intent to marry, make photocopies of your boarding passes and other physical evidence, seal it all up and drop it off at the nearest posta. So yeah, you can definitely file as soon as you get back.

Your question was still very vague and confusing but let me see if I get what you're asking.

You can get all the paperwork on your end ready before you go and bring it with you to Ukraine. Once you get there, you can have her fill out the G325A, sign it and get her passport photos...or she can do that before you come and have it ready for you to mail the day you get there. You will need the boarding pass that you went or some proof that you have met in the last two years to send with the packet. A dated picture is also good secondary evidence. I would avoid sending the petition incomplete because there is always the chance of a denial, and then you are out a lot of money and time.

There are quite a few people that have taken it all with them on their very first trip to physically meet. If all goes as you planned, then all your lady has to do is sign the G-325As (I'd have her sign an extra set, just for safety sake.), the Letter Of Intent To Marry, and give you copies of her translated birth certificate and divorce document (if that applies to her). You'll be just that much ahead!

A denial is based on the evidence provided. If you don't provide the evidence, they can't make a judgment. All they can do is request that you provide the missing evidence.

Also, anecdotally I haven't seen a single filer on VJ turned down because they initially filed incomplete.

At the time that you file the petition is when you need to have the proof that you've met within the last two years. You can't do anything before hand. Just bring back with you the signed documents from her to file with the petition. Also, if I'm not mistaken, you must file from the US, not from the Ukraine. There are no documents that you would need to leave with her in the Ukraine at this point. When it gets closer to the interview date there will be, but those documents (proof of ongoing relationship, affidavit of support, etc.) need to be current. Just go meet, get plenty of evidence, have her sign the G325A papers and bring some passport photos of her back with you. It will be months before you need to send anything to her FedEx, and as I stated, those documents will need to be current. Good Luck and Safe Journey.

You can actually mail the packet from anywhere in the world. But your filing address must be in the United States.
