I would to ask my situation, I was once had a k1 visa nearly 2 years now, I got the visa and went to United States, however me and my ex-fiance didnt get married,I didnt want that to happened but due to unavoidable circumstances,we separate ways.

Im aware about the rules of the k1 visa if u dont get marry within 90 days u have to go back to your homeland, thats what I did, before my visa has expired i went back to PHilippines, and now i met my guy(different person)we love each other so much, he wants to file a k1 visa for me so we can be with each other permanently needless to visit Philippines once or twice a year,I know you understand how difficult it is when u are far away from your loved ones.My questions are, Is the immigration will deny our petition because i had previous k1 visa?will it be an issue to the immigration that i had a k1 visa before ?and what are the possible things will going to happen in our case?

What are the possible redflags regarding our case?

I really appreciate any advices and informations. THanks in advance!

Im so anxious now.and has anyone have gone on the same situation before?

Your situation is a bit different from mine. I cancelled my fiancée's first K-1 just prior to her interview at the Embassy for personal reasons back in 2005. We were never out of love, the timing and some other issues made it not good for her then. We refiled this year. I explained the situation very well when I re-submitted the petition. So far every thing has moved along with no RFEs or any other issues.

They will not deny your petition because of a previous K-1 Visa.

will it be an issue to the immigration that i had a k1 visa before ?and what are the possible things will going to happen in our case?

You will be asked at your interview why you didn't marry. The fact that you did not overstay your Visa works hugely in your favor. But be prepared to answer questions about why you decided not to marry. Be honest, explain the situation, and you should be fine.

Based on what you've said, the only real red flag is that you didn't marry on your K-1. As I said, they will want to know why, and they will probably also want to know why you think it will work out this time around. The best thing you can do is have all your paperwork perfect, and make sure your evidence of a "serious relationship" is rock solid.

Don't worry too much about it. Just be honest, have all of your paperwork and evidence in order, and you should be fine. Best of luck to you!
