Sorry I haven't been on in a while. I need help/advice again. This time things are more complicated. As stated in my post a few weeks back, I went to Morocco in November to visit my honey. Well, to make a long story shorter, I came back with a present I didn't know I had, I'm expecting our baby. Wow. We were not planning for this. Now here is my/our dilemma. We did plan on getting married someday, but not this soon. Obviously we will have some proof of a relationship now. LOL I just don't know what to do. Should we apply for the K-1 and hope he makes it in time for the birth? Should I go there again while I can still travel, get married, file spouse visa form, and hope he makes it in time for the birth? I just have a feeling things will be denied because of how quickly things have happened. I am just confused on the best course of action. Any advice on which way is best, spouse or fiance visa in this case?

Well the fact that you're pregnant will have no bearing on your case I'm afraid to say. There is a slim chance he might be in the US for the birth but I wouldn't count on it. As far as which route you decide to go ultimately that's up to you. If I were you I would plan to go about this as though you were a single parent (sorry I know that sounds bad) but get yourself lined up with enough money set aside etc to help out. Honestly if you're not married it's going to be easier to get help. Even if he is here he won't be able to work. I hope that you can get some money set aside etc. I don't know what your job situation etc is.

Long story short they're not going to deny you because you're pregnant. They're not going to move your case any faster no matter which visa you decide to file for. If you weren't planning on getting married yet, I wouldn't get married just because you're pregnant,.

Congratulations on your pregnancy! Unfortunately, there are no guarantees. Whichever path you choose you may end up with unexpected delays. If it's very important that you be together for the birth, you might want to file a K-1 and hope for the best, but plan to go to Morocco for when the baby is going to come to be sure. If you get married and file for the K-3, you'll have to do the legwork of the marriage (which I'm told takes a few weeks in Morocco), then file the K-3, which tends to take longer than the K-1 anyway. Of course, if it's important to the two of you that you be married prior to your child being born, then you'll need to go there, get married, and file for K-3 (or IR-1). You and your fiance should try to figure out what's most important to the two of you now.

Pregnancy and motherhood have no impact whatsoever on your application.

Filing a K visa, whether fiance or spouse is the same thing. The cool thing about getting married (amongst many others, of course) is the chance to apply directly for an immigrant visa (CR1 in your case).

Congratulations on your pregnancy. Unless you have the extra money, you could set that money aside for the birth of your child and file the K-1. Filing the K-1 will mean he will probably make it quicker to the US. You can file that paperwork now. If you wait and return to Morocco to marry and file the K-3, it will just take more time. It's up to you, of course, what is most important. Your pregnancy will have no baring on your approval either way.

Hi, as a long term teacher, I can't help but ask how long you have known this man. I will give you the same advice I give to my students: Always be prepared to take care of yourself and any children you may have by yourself. I think that sort of sums it up. I hope you have a good job and are able to make some well-thought-out choices as to what is best for YOU and the BABY. Is this man a stable guy? Hard worker? Nice supportive family? How old is he? How old are you? Does he have a history of responsibility????? What is his reaction to all of this? How about his family--how do they feel?

Pregnant women (at least Moroccan women) that aren't married are not treated very well in Morocco. I hope you are a strong woman and can keep it together through the upcoming months.

I don't mean to sound negative, just realistic. I do wish you the best and hope everything turns out well for you. Be good to yourself and we love and support your decisions.....D

PS--I went back and looked at your profile. I see that you are both in your 30's, so that helps. Do you have other kids? Are your parents supportive of you? All of these things you need to consider.

If you weren't planning on getting married yet, I wouldn't get married just because you're pregnant,.

Why did you say emphatically that he wont be able to work? HAve things changed in the past 9 months that K1s cant work anymore?? IF he comes with the work stamp and they get married right away, he should be able to at least work for a few months,which is better than nothing. And if they file for AOS right away there may not be too big a gap between the temp expiring and EAD arriving. AND depending on the employer they may let him continue anyways. One never knows. Give the girl a little hope.

You have been given good help but dont make to far extended plans as you dont know if or when he might be here, hope for the visa but plan for the worst case to keep you and the baby going if you are alone for an indefinate time, this can be a time extended process as some of us know, good luck
