I130 Question

I am preparing the I130 to bring with me next week when I go see the wife. On the form there is a place to list the children. So, my questions are:

1 - Do I need to fill out a separate I130 for the 10 yr old daughter?

2 - Do I need to list our 8 mo. old son who has already been registered with the embassy and is a US Citizen?

Then for the 325A forms:

1 - I know I fill out one for me and the wife, but what about the daughter and son?

Timeline

1) Yes, if you are going CR-1 visa you need I-130 for child, but for K-3 you do not need to file 1-130 for child K-4 is a derivative of the K-3.

2) Yes, you list all children on the I-130, even the ones with US Citizenship.

I recommend sticking to CR-1, it saves you from the headache of adjustment of status, and EAD.

Only G-325A needed from parents.

I recommend you bring back the signed G-325A forms, as well as the DS-3032 and DS-230 because they will have to be signed by your wife once your case is approved and sent to the NVC. This is of course if you decide to file for the CR1 visa.

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Thank you for the quick replies. Ok, so I will need to fill out a separate I130 for the daughter, but not a 325A?

Also since the son is already a US Citizen, he must be listed on the wife’s I130 but I won't need to fill out a I130 or a 325A on him?

I suppose I will also have to pay an additional $355 for the daughters I130?

I had planned from the very beginning to go the CR-1 route. Instant green card is a big incentive and by the time they get the visa, we will have been married for 2+ years.

Yes, and Yes, Son is a US citizen and not IMMIGRATING so no I-130 or G-325A.

Also: Later at the consulate interview stage, DS-230 for mother will indicate "21a. Person(s) named in 14 and 19 who will accompany you to the United States now." you will list both children on the form in section 19, but only daughter is "Immigrating" so only daughter is accompanying. Son is traveling with, but is not immigrating so need not be listed on line 21a. This is common also when a US Citizen spouse travels to foreign country to accompany the immigrant back to the USA, the US Citizen spouse (indicated on 19) is also not listed on 21a.

Feb 1,2007 - I-130 Reached USCIS.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1
