I am just wondering whether it is legitimate to apply for the business visa during the process of K1 application? If applied for, are there any chances for approval? or if got rejected, would that affect the K1 visa? Anybody knows about it? Looking forward to the answer.

It will not affect the K-1 Visa. What kind of business visa are you talking about?

I think the OP is talking about a B-1.

Being approved or not.. depends on the foreign fiance's situation and the CO's criteria. Some CO's have denied B1/B2 Visas, even when the applicant met the rest of requirements, in cases where the K-1 process is pending because they interpret there is an intention to immigrate to the US. And some other CO's did not interpret that the K-1 filing was an obstacle to grant a B1/B2 visa, and they did approve the visa.

What is the purpose of the trip you are planning? Are you attending a conference, a meeting or a bussines convention or closing a deal in the U.S.? If so, keep in mind, that you (or your fiance) will need all the supporting documents to prove the purpose of the trip aditional to all the documents to prove ties and economic situation in your home country. If the purpose of the trip is to visit your fiance, you should file for a tourist visa (B2).

In any case, as Mox said filing for a bussiness/tourist visa whether it is granted or not wont affect the K-1 process.

Of the cases I've known here in VJ 2 of 3 K-1 filers have been granted a tourist visa and 2 of 2 K-3 filers were denied.

generally for a business visa you have to show the business is over $100,000 per year and that you will employ more than 10 workers. its not a work around to come here while waiting for K1 or CR 1 etc.

Not much chance at all unless there are strong ties and heavy assets in China along with previous use of a Business visa without overstay. Even with all that, the chances are slim, coming from China.

Chris

You're talking about EB-5 for investors which allows you to apply for residence by making an investment in the US. I believe the OP, is talking about B1 - Bussiness Visa.
