Hi,

I am filing AOS for my wife. She is here on a K1. I filled the I-864 out fine... but I have a question about part 1. What box should I check off as the basis for filing the application?

Requested EAD Expedite: 11-12-2008

EAD Card production ordered: 11-12-2008 changed to 11/17/2008 Why? (I hope it doesn't change every week!)

Received AP: 11/17/2008

Received EAD: 11/22/08 (Praise God!!)

AOS RFE: 1/29/2009

AOS Approved: 3/24/2009

Called USCIS 4/1/2009 told no status change and case not yet reviewed from RFE request.

Received green card: 4/3/2009

I have! There is specific answer to this question... except that a I-864 must be filed! I guess maybe this is a a better question... does the word "petitioner" on I-864 Part 1a mean... the person who is filing I-485... or the sponsor filing I-864?

Ok this is what it says:

A sponsor completes and signs Form I-864. A sponsor isrequired to be at least 18 years old and domiciled in theUnited States, or its territories or possessions (see Step-by-step Instructions for more information on domicile). The petitioning sponsor must sign and complete Form I-864, evenif a joint sponsor also submits an I-864 to meet the incomerequirement. The list below identifies who must becomesponsors by completing and signing a Form I-864.

Who Completes and Signs Form I-864?

The U.S. citizen or lawful permanent resident who filed aForm I-130 for a family member, Form I-129F for afiance(e), or Form I-600 or I-600A for an orphan.

The U.S. citizen or permanent resident alien who filed anemployment-based immigrant visa petition (Form I-140) fora spouse, parent, son, daughter, or sibling who: (1) has asignificant ownership interest (five percent or more) in thebusiness which filed the employment-based immigrant visapetition; or (2) is related to the intending immigrant as aspouse, parent, son, daughter, or sibling.

So, the petitioner is the sponsor, which is the US citizen, which is you.

Take a look at the example forms here, I used they through the K-1 and AOS, worked perfectly. :thumbs:
