My EAD is denied

I have had some problems on my EAD application and had a topic recently you can read on this link

My old topic

Yesterday I could see online that CSC had made a decision and they have send me a notice of further instructions.

I was curious about the decision and called yesterday the customerservice where it says that my case is denied.

Since I did never recieved a Notice of action from them I am in doubt if I have missed something.

My lawyer gave me the recieptnumber for a while ago. Does that means that he recieved the NOA?

I can't even contact him since he is on vacation until july 30.

And I am in doubt if they are only sending him the informations on my denial and this way I don't know what to do.

I am so devastating right now.

Does anyone know what the reason can be of my denial?

Can it be the changes they had to make from code a6 to c9?

My sons application is still pending as normal.

I'm sorry your case was denied. Your lawyer probably got something in the mail about the case, and didn't notify you. That's one of the disadvantages of using a lawyer versus doing it yourself. I can't think of any reason why they would deny you. Maybe your application should have been sent to Missouri, instead of San Diego. I suggest you make an infopass appointment to find out the details. And tell your lawyer to get his butt out of vacation right away, and work on your case. You should be getting your money's worth. Good luck.

EAD should have been filed for with or after AOS filing, and sent to the Chicago lock-box.

When filing for EAD before AOS the EAD expiration is tied to the I-94, and is considered to be the Temp EAD that is sometimes issued at the POE. This EAD is virtually useless due to processing time, in this case the I-94 had expired by the time that the "Temp" EAD would be issued, voiding the "TEMP" (a )(9 ) "Before" AOS EAD.

The only visa holders that benefit from filing for EAD before AOS are K-3 visa holders, K-3s get an I-94 card with a 2 year validity, and such filing for EAD before using (a )(9 ) will result in a 2 year EAD card.

The lawyer in this case did not completely understand the K-1, and what happens when filing for EAD before AOS.

What I didn't understand was which one they had denied - the one coded a6 or the one coded c9?

Well, I think until you know which one was denied and why, there's not much more you can do. I've never heard of USCIS 'changing' horses midstream as your attorney suggested (when he said he'd have them change that a6 to a c9) and it working out.

Did the attorney ever submit - at HIS expense - a new EAD application, coded as a C9 and with proof that you have filed the I 485 (namely the receipt/NOA1 for the I 485)?

Yes I have recieved this NOA from AOS and have the biometric taken already.

What's very confusing for us is that he send our EAD to a local office because they do some special things in San Diego area.

Yes, well, as I said before in another thread about this very subject: we did the exact same thing. They denied. We were required to refile with the correct code and repay the fee. Once it all played out, all was well.

If he did not send a new application - coded correctly with C9 and having proof of the I 485 filing - then its no wonder it (the a6 coded one) was denied.

I would refile with c9 and the NOA1 from the I 485. Or have the (useless) attorney refile and pay for it as he offered (and rightly should).

Yes I feel better now because I am so sure that the a6 situation is denied and they want me to refile. Too bad that he is out of the country and can first do this after. I am happy he offer to pay since the fee will be more B)
