Does Age Matter????

This is the first post for me and I hope someone will be able to answer my question. My fiancee is 22 years old (male) and I am 51 years old (female) so there is quite an age difference between us. We met online and have documentation (emails, IMs etc) to show proof of our relationship being legitimate.

My fiancee is very worried that the consulate will deny us based on our age difference and I think he is wrong and they are not legally allowed to deny on that basis alone. There have been men with this age difference over their fiancee's for years so I dont see how they can discriminate because I am the older and female.

Does anyone know for sure???? Can we be denied just for having this big of an age difference between us with him being the younger??? I have already traveled to his country to meet in person and now we just need to apply for the visa.

This question has been asked before and it is often asked by people with fiancees from Morroco. Hmmm. It will not matter for the I-129f. For the visa interview it can matter, though not officially. If what you are doing goes strongly against local culture and customs (it does in Morroco if you are the female and older than the male) it will be a "red flag" which must be overcome. There have been many threads explaining problems with this issue in some countries.

You will not be denied for the age difference, per se. I have not seen that. The typical Euphanism is "not clearly eligible" Do not apply US "rights" to receiving a visa. Your fiancee is not entitled to one and it is entirely the disgression of the consulate to issue it. You will need to have very complete and thorough documenttion of ongoing relationship, I would imagine.

They can NOT deny you based on the age difference alone. It may cause you to get more scrutiny but this will depend on the person who handles your case. You will find several women on this board who are in the same boat as you. IE older than the man. Several have adjusted with no problems and others have had some difficulty. You and your fiance know your situation better than anyone on this board will. People on here can answer a lot of your questions that may arise during the process.

The first thing I suggest is read the guides pinned to the top of the main page.

Also, if you look closer to the bottom of the main page, you will find boards that are region specific. A lot of people on here can answer your general questions about the K-1 visa but, the people in your region could provide you with a more in depth view of what you may encounter at the consulate that your case will be sent through.

I would go down to the Regional Section and find Morocco

Ask them down there

I think age difference, would be consulate specific.....

casa wont SAY they are denying because of age but its a good suspicison that is the reason, Casa is hard to get thru so you willhave to be very prepared. Although age on paper is one thing, think about it for life time decisions...this 22 year old person is not the same equal to a 22 year old boy you know next door here. He has prob been sheltered by his family and has no idea of lifes problems as to responsibilities and work and bills. I will speak up not sure anyone else will but this age thing can tend to be a problem so step back and rethink it i know there are others with same situations...yes we are fine in general but you will be surprsed to learn the differences later.... i would guess take off about 10 years and this is the person you will realize, think about things you have in common also at 50 are you consentrating on your work, working for retirement, fixing up your house, settled into your life style? then bring in this young person who probably cant fill out a work application, our WORK and theirs are very different in idea, you have to tell them everything that needs to be done and when. Then you have the prob of is this sistuation just a dream to them to come here, after the job, then top on their mind is just save for THEIR trip home, etc their dreams.

Like i said we are fine but we have luckly worked thru some of these things, just look at your situation good and give it alot of thought, if you need talk email me

Consulates in Africa have a way of reacting to major age differences. While they do not "deny" visas, they do return the papers to USCIS with the recommendation that the action to approve the I-229f be revoked. Even careful documentation of the validity of the relationship isn't good enough. He will need to know all about you and your past for the interview. You should make plans to be there for the interview, even if you aren't part of it.

first who is this?

my k1 was returned reason given: it was expired not denied (per Calif) so who knows true reason, each case will be different, best case to be accepted will be a TRUE case and in time they will see this, put in enough time and effort and good cause, it will happen

So would a person have a better chance of getting their spouse here if there was an age difference verses a fiance?

prob if there WASNT a age difference would be perfect but since this isnt a perfect process or life we go with what we have. Being single and age difference will raise questons but being married is no guarantee either. Seems your married what do you think?

So you are 51 and he is 22. 29 yrs age difference. Mostly this wont create any problem. I am the non us man 32 and my wife the usc is 57. We do not have any problem personally. So long in the AOS journey there has been no problem. They cannot deny you because of age. However they may ask him some questions like why is he choosing such an elderly lady. If he has good proofs and can convince them he wd be fine. Consulates does look at things closely just to ensure that the relationship is entered in for love and not for green card interest. March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

My husband is 25, I am 41 and there was no problem at the interview despite older woman/younger man being against local tradition - though I have read that Casa is notoriously difficult, much more so than Kathmandu. Show a lot of evidence including photos with family, show that family supports your relationship. Of course some families have been known to be in on the scam as well, if it is a GC scam and this is the chance for the son to go make money for the family, but I know in our case that our photos really convinced the CO, especially since we looked so happy together and in love. One question the CO might ask is does your fiance want kids, if so is he willing to adopt and how does his family feel about it, have him prepared to answer that even if it doesn't come up in the interview.

Definitely yes, you have a problem. It may be overcome but it IS a problem, whether any of us agrees it should be or not. The solution will be to actually live, have and demonstrate with clear evidence, like a bona fide couple lives. If you've had only one short visit, multiply the difficulty several times. The best evidence a relationship is bona fide it the time you spend together and how you spend that time.

The facts and evidence need to be convincing enough to overcome the natural conclusion that the relationship is solely for the purpose of obtaining an immigration benefit for the foreign national.

If hearing such things brings out indignation, it's critical you get over it, critical to your eventual success of failure. If there's a denial, not a word will be mentioned about the age difference. It will all be about the bona fides of the relationship.

Facts are cheap...knowing how to use them is precious...
