1) On question 23, the "current annual income" refers to 2007 or 2008?

2) My husband worked for less than 6 months in the year 2007, so his total income in 2007 doesn't meet the poverty guideline. But, his 2008 income should meet the poverty line, do we still need a co-sponsor in this case?

It's the most recent of income tax year, so 2007 if he already file, if he doesn't do it yet, it'll be 2006 year. In the employment letter is where he will show an estimate of his earns for 2008

Yes, you need a co-sponsor who meet the 125% poverty line in the last income tax year.

You can be as "current" as you need to be. It sounds like you need to state his anticipated and supportable annualized income for 2008. Calculate that by any appropriate method but then provide an employer letter and pay stubs to support it.

Many would simply state the 2007 income if there's no reason to do otherwise. This is what I did because my income is unpredictable and my most recent tax return showed more than sufficient income. I also included current pay stubs and employer letter to demonstrate I was still employed and making sufficient income from the same employer as shown on the most recent tax return.

If one became unemployed in January and remains so, stating their 2007 income as "current" would be untrue.

My husband did not have 2003, 2004 tax returns(he went back to school) and no 2005, 2006 tax returns (he was living in Malaysia), so the most recent tax return is 2007 (which he has just filed), but it doesn't meet the poverty guideline as he worked for less than 6 months in 2007.

With his current job (started since Nov 2007), his annual income in 2008 should be over the poverty guideline. If we opt to have his expected 2008 income as the "current income", do we still need a co-sponsor?

We are trying to figure out whether it's necessary for my father-in-law who has agreed to be the co-sponsor to fill up a I-864 form.
