No G-325???

Hi all.

I sent in the I-130 packet way back in December (dec.11, 07) and also have a NOA1 and I'm also showing online as pending with my receipt number.

My question is, I keep seeing posts about the G-325 forms in the 1-130 packets.

I didn't fill these out because they were not in my packet so naturally I didn't fill these out. Only filled out the two forms that say Petition for Alien Relative (for my husband).

Does anyone think I'll get a RFE for this considering they were NOT in the packet and also don't show ANYWHERE in the downloadable I-130 forms on the USCIS website?

So far, I haven't received anything from them and everything looks to be ok,...but still I wonder.

Also, I am not sending the I-129F because me and my hubby don't want the hassle of that compiled with him having to wait months to get a work permit. He is African so you all KNOW we CAN'T be sitting around twiddling our thumbs waiting on THAT CARD! We have family to support. hahahaha

Any comments on the G-325 forms?

06/05/2008 - Filed 2nd request

06/23/2008 - Expedite Approved

07/27/2008 - NOA2

10/21/2008 - Case complete at NVC (Technically was expedited to embassy)

11/06/2008 - Interview at Dakar Embassy

11/06/2008 - Notice (show more income evidence from petitioner)

11/07/2008 - Case on hold

11/18/2008 - 2nd Interview Date

11/18/2008 - Notice (Show even more income and ORIGINAL docs now from 1st cosponsor

12/23/2008 - Received email for 3rd Interview scheduled for March 25th, 2009. Bring Pics

01/23/2009- In Gambia with hubby

03/25/2009- Interview

04/09/2009- POE Atlanta (CR-1 Status until 2011)

04/13/2009- husband arrested for domestic violence (Aggravated Assault-Felony)

05/19/2009- Filed for divorce

06/02/2009- Letter sent to immigration detailing abuse & fraud

09/08/2009- Divorce Hearing

09/10/2009- Divorce Trial (Continued)

03/11/2010- Notice To Appear issued

03/22/2010- Divorced

05/18/2010- Deportation Master Hearing

05/18/2010- Deportation Ordered

06/17/2010- Appeal Time Over. ICE picked him up. In Jail

08/10/2010- Another Master Hearing Scheduled. Out of jail.

05/31/2012- Individual Hearing Scheduled

in the instructions for the I130, it says to fill out the G325 for the petitioner and the beneficiary.

Correction: The instructions indicate filling out a G325a (quadruplicate form) for petitioner and for beneficiary. G325 is not the correct form.

Yes, you will probably get an RFE.

Further, the instructions indicate the need to send other supporting documentation as well. I'd be studying those instructions and getting anything else on the list ready for the RFE too.

The G325 biographical data is not optional. The129 is. You will get a RFE, or entire package returned for missing/incomplete forms. You need to read,and understand the info in the guides section! If you do not understand, then ask as many people here will help! I hope this helps... john&jean :yes:

Hmmm...maybe I'm slow,...but their is no G-325 in the I-130 packet. Though the forms I filled in look like the same info requested on the G-325.

Anyway, if this form is required, WHY was it not in the official packet or even mentioned?? Not blasting anyone, just want an opinion.

And since others say it is needed, should I send it in now with a copy of my receipt or wait for an RFE?

I DEFINITELY don't want my packet returned and would rather have an RFE anyway. I'm so close now.

That is just the I-130 that you linked. If you read the instructions to the I-130, it says at the very end of the instructions:

If you are filing for your husband or wife, did you include:

His or her photograph?

Your completed Form G-325A?

His or her Form G-325A?

Also, you should review the VJ guides on IR-1/CR-1s so you can gather anything else you might have missed.

Yes, I agree. You might get an RFE. So please start preparing two sets of G-325A, one for the petitioner and the 2nd one for the foreign alien spouse so that you can send them right away.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

It is most likely the OP will get an RFE and USCIS will not entirely reject the petition. USCIS tends to reject petitions prior to accepting the fee and then they return the entire packet with the uncashed check.

Please be careful. Neither the G325 or the I-129 are applicable. The applicable forms are G-325a and I-129F.

It is critical to pay attention to details.

There is no "I-130 packet". There's just an I-130 and I-130 instructions. The instructions tell you what other forms to send. If you just sent an I-130 and a check, you might as well start over from scratch because if there's an RFE it will be for a lot more than just two G325a forms.

You'll need a marriage certificate and petitioner birth certificate or passport copy at minimum in addition to the G325a's.
