Not Denied, BUT...Request For More Info After Interview

It's frustrating! :( My husband went to his interview on February 5, 2010.

Everything went well until the interview. After waiting 5 :huh: hours inside the consulate his interview only lasted 5 minutes. They then told him all was in order but they needed more proof of our relationship. He had brought them our wedding pictures and letters. They sent him home and said to mail all evidence and his passport through DHL.

Is it possible that they will? Has anyone heard of them doing this?

They told him that he was not denied, because if he was they would have told him so and would have him fill out a waiver. But that as soon as they recieve the requested info they would send back his passport with his approval. I have not read of anything like this before. We were not prepared for that.

I sent the extra information requested and now are waiting! Please if anyone has any advice or experience, let me know.

Ok, that's kinda of a rare request for Juarez, but many other consulates such as Casa deny outright rather than allowing you to present more evidence. I would search "bonafide marriage" here on VJ for more ideas of what to send and make sure you send plenty of legal documents as well as proof that you two are in a relationship. Sometimes when they request more evidence consulates put people in administrative processing while they process the new evidence. I really think they will give you the visa but I can't promise anything. You might want to have your Congressman get in touch with the embassy once they have had a little time to process it or call the "extortion line" (the embassy) to see if they have made any progress on it.

April 19, 2010 - NOA1 (documents received at Mexico City Embassy)

April 20, 2010 - NOA2 (received notice April 28, 2010, mailed April 27)

May 3, 2010 - Packet 3 sent (received May 27, 2010)

May 9, 2010 - I emailed them using the inquiry form asking for my case number

May 17, 2010 - received case number and link to Packet 3 by email

May 18, 2010 - sent Packet 3 to Ciudad Juarez

May 28, 2010 - called Ciudad Juarez to see if we had an appointment yet, they said wait 6-8 weeks :(

May 30, 2010 - I return to the US

June 8, 2010 - called and found out appointment date

June 16, 2010 - received Packet 4

July 6, 2010 - interview - Approved!

July 7, 2010 - pick up visa at DHL and POE to activate

July 29, 2010 - welcome letter received

August 1, 2010 - my husband comes home to me

August 13, 2010 - received Green Card

September 28, 2010 - never received Social Security Card, had to apply for it, arrived Sept. 28

Do you have any of the following to send;

email between you two

telephone bills showing you two talked

internet chat sessions

Were there any visits between you with travel logs or airline tickets?

First off, they told him it wasn't denied. So, it wasn't. Secondly, they asked for more evidence. Have him send it! He's to send his passport back at the same time as well, so I would think that means that with the correct information, he WILL be given the visa. That's why they want his passport, so they can place it in it. Please let us know the outcome!

Thank you all for your advice. I went ahead and mailed all phone records between us for last year. It was a lot :yes:

We sent it and they have recieved it so it's only the waiting now! I will try the suggestions on calling and searching. I will let ya'll know if anything new arises or if there is an outcome. :thumbs:

maybe you were scant on the I-130 petition area for 'evidence of bonafide marriage' -

and you didn't bring anything 'new' for interview day.

Here's what I did on initial I-130 submittal -

IMO, it's not just 'record of contact', but 'record of co-mingling finances' ..

Honestly I sent all I could. I sent an sworn, notarized affadavit of relationship and marriage from 2 other people, non family members. We do not have joint accounts because my bank does not allow a non-SS holder to have a bank account. He took photos of our wedding, dating and after to the interview. I honestly tried all I could.

They sent out the DHL package back to us on Friday!!!!

Waiting to hear what they said. I will post ASAP!

I would recommend that to anyone with my same situation.

We received the package from Juarez on Monday!!!

They approved his visa and he will be home in 2 weeks.

Thank you for your advice and honestly if I had not joined this site I would have

never known all the extra things to for the filing and for the interview.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
