Timeline

Hi guys,

My parents are sponsoring my fiance and are working on the forms right now. Since the forms have room for only one persons name/details, is it ok for my mom and dad to fill out two seperate I-134's, although they are sponsoring together?

I hope this isn't a ridiculous question. Thanks for your help:)

If they file taxes jointly only only I-134 is needed from the head of the household, as well as one from you, the primary sponsor.

Point of clarification: this is a K visa situation, not an immigrant visa situation - the petitioner is not the primary sponsor, is not a sponsor at all if they are not financially qualified.

Often the consulate will ask for an I-134 and other financial documentation from the petitioner, because the petitioner is most often the sponsor, but some K visa applicants in the UK have found that they do not need to submit financial documentation from their petitioner when they are using someone other than their petitioner as their sponsor.

Yes, I have an email from the London Embassy stating that only my parents need to fill out the I-134, not me too.

So it should only really be one form?

@yodrak since you seem to have an answer on everything and for everybody i thought it wouldnt hurt to ask you some stuff i couldnt figure out till now!

so thats the situtaion: my fiance was in the air force untill the end of december, right now hes unemployed and job hunting. hes just looking for the good jobs to earn as much money as possible cause he wants to sponsor me by himself. do you think theres a chance this could work? lets say he gets a job in may or june and earns enough money to meet the requirements (100% of the poverty line??) for the yearly income, and fills out the I-134 in july, do you think they would approve my visa in frankfurt?

if this is not working out we just need to get someone else to sponsor me i guess! does just this person have to fill out the I-134?or both my fiance and the person who is going to sponsor me?

the houshold size depends on the persons claimed on the tax return, right? or how do you get the number of people for a houshold so that you can check the money needed from the poverty line columns! its not the persons living together in one house right?

i really hope you can help me out!

The requirement is for a current income that meets the requirement when expressed on an annual basis. It must be sustainable income - a temporary job that will last for only a limited period of time is not sufficient. There are other factors to be considered as well - 'the totality of the circumstances' - as described in 9 FAM 40.41 Notes. I could not tell you how a particular consular officer might decide based on the documentation that is presented, even if I were to be given the same documentation.

It might not be necessary for your husband to put together a financial information package if he does not qualify to sponsor, but it would be prudent to do so in case it's asked for. And who knows - if you think the situation is marginal it just might be found to be acceptable.

There is no 'household size' defined for the non-immigrant visa situation. There is a listing of dependents. A sponsor must be able to support themself, their dependents, and the visa applicant they are proposing to sponsor. And a person may have dependents who they cannot claim as dependents for tax purposes.
