K1 - Social Security Card

Timeline

Went to the social security office today and they said they wouldn't approve it because Sam doesn't have an EAD yet. I even brought the policy that states otherwise and they said they couldn't complete the application in the system without it and that the policy only applies to other things, yadda yadda. I dunno what to do. =( Can we apply for it later after we get the we get married in two days and file for an EAD? I dunno how long that would take to get! I need advice, please help. =( I was relying on this so we could file with additional evidence on our AOS.

Can I add him to my bank account or bills without one? I don't think so. :(

You dont need EAD to get the social security card. I would try going to another social security location. All he needs is the passport and birth certificate. Whoever you spoke to at that office has no idea what they're talking about. Usually this happens in small offices. Try going to a bigger office where they might be more knowledgeable.

You need to give it a few weeks after entry, and then apply for SSN, SSA will not issue one within 10 days or I-94 expiration.

Visit a different office.

Ok, I think I checked the wrong box on the form. Should be Legal Alien not allowed to work instead of Legal Alien allowed to work. That's why she probably got the error message on her computer ugh.

But in the instructions it says if you check that reason you need to provide a document from an agency that explains why you need a ssn# if you're not working and that you meet all of the requirements etc ? What did you all do there?

Do not leave until you speak to someone trained. It may take a while. K-1s are most definitley entitled to an SSN as soon as they arrive. My wife applied 16 hours after arriving and had her card in hand 6 days later. SS is a federal program, the rules are the same throughout the country, if my wife or ANY fiance(e) can do it, so can yours.

As an alternative, drive to Burlington VT where the clerk is well trained and will sign you immediately. You can apply at any SS office in the USA.

Moving to the forum for SSN's where there are a number of threads on this topic. Look for posts by I_Quit. Your husband is definitely eligible for his SSN, Karri.

As for your question regarding adding him to your bank account and bills without an SSN.... it varies. Some banks won't allow it. My bank used my husband's SSN and told me to give them my number when it arrives. Not having an SSN is definitely a hindrance to doing much of anything in this country, so definitely keep trying.

:no: A K-1 is a "Legal Alien Allowed To Work" this is the correct box on the form.

SSA WILL mark the card "Valid with DHS auth" this instructs employers to require an EAD card before hiring the K-1 holder.

C. Policy - Employment Authorization by Class of Admission

The following sections list nonimmigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

K-1 Fiancé(e) of U.S. citizen

Again, K-1 is NOT a work visa, it is a fiancee visa that is for entry to the USA and marriage. SSA is told by USCIS to treat K-1 like a work visa so that they can get an SSN. Some states REQUIRES SSN before they will issue a marriage license. This is why the other K-Visas cannot get SSN, they do not have the marriage license issues, K-3 is already married, and K-2 and K-4 are children not in the USA to get married, so do not need SSN right away.

#1 your passport

#2 your K1 visa

#3 your UNEXPIRED I-94 showing more than 10 days before it does expire.

#4 your marriage cert.

This is all you need!!

Also make sure to check the box that says you are a legal alien allowed to work. For getting a SSN card your K1 authorizes you to work. At least until your I-94 expires... I think. Anyway, it does allow you to check that box.

Not anymore, Since last month form I-9 used by employers to record confirming work authorization specifically indicates Photo ID EAD card is needed for non resident aliens, or green-card is needed for resident aliens.

Technically, you are eligible to receive one. Many SSA employess don't know what the hell they are doing. Try asking for a supervisor next time you go. But I wouldn't waste too much time or get stressed out over it. What do you need a SS number for before you have an EAD? You don't. You can't work with it anyway, so it's nice to have but not necessary. Once you get the EAD, you can go and get one.

It's not as simple as you make it sound. You can apply after you get married & have the marriage certificate in hand, but before the I-94 expires (apparently 14 days before it expires). The problem is that most people don't marry right away (we married about 2 months from my fiancee's arrival) & if you add the additional 1-2 weeks to get the marriage certificate you are at or the near the deadline for applying for a SSN. I know because we applied last week & were turned away because my wife's I-94 had expired.

From what I was told by SS you have to wait until you have the green card in hand. Everyone is quoting this & quoting that & they may be right, but if you can't convince the SS rep to give you a SSN it doesn't matter if you are "right" or not.
